At Ennis District Court on Wednesday, 16 June, Garda Inspector Tom Kennedy said that will be the allegation against Mark Brohan (35) of Rinlea, Tubber, Co Clare, who is charged with assault causing harm of Sean Glynn (65) on farmland near Tubber on 12 April, 2016.

Solicitor for Mr Brohan, Daragh Hassett, told the court that his client would be putting forward a defence of “self defence” when the case goes to trial.

Medical report

Inspector Kennedy handed in a medical report into court which shows that Mr Glynn sustained a broken jaw and had to get a metal plate inserted as a result of the alleged attack by Mr Brohan.

After viewing the medical report and hearing the outline of the case, Judge Patrick Durcan said that he would not hear the case and has transferred it to the circuit court where more serious penalties apply.

Prison

Those convicted of assault causing harm in the district court are liable to prison terms up to 12 months and this increases to prison terms up to five years on conviction in the circuit court.

Facts

Giving an outline of the facts, Inspector Kennedy said that Sean Glynn and his brother live together at Ballyogan, Tubber and were having lunch on 12 April last.

Inspector Kennedy said: “They have adjoining lands with Mr Brohan and Mr Brohan went to Mr Glynn’s house that afternoon to express his discontent at the straying sheep from Mr Glynn’s land on to his land.”

The inspector said that the two Glynn brothers told Mr Brohan that they would be down to the lands to deal with the problem after their lunch.

Inspector Kennedy said that the lands are about a mile away and when the Glynns did arrive, they met with Mr Brohan, who had the sheep rounded up and penned in a holding area.

Inspector Kennedy added that the allegation is that Mr Glynn will say that he approached Mr Brohan and Mr Brohan struck him with a large stick or a plank of wood.

Evidence

After Judge Durcan said that he would not hear the case, he adjourned the case to 20 September to allow the State prepare a book of evidence.
