Who has the responsibility for BPS entitlements?

BPS entitlements remain the property of the landowner. For the period of the lease, they are claimed by the farmer on behalf of the landowner; a transfer of entitlements application is submitted to The Department of Agriculture to this effect.

Standard cross-compliance becomes the responsibility of the farmer, where cross-compliance issues are due to structural defects in the farm it is something the farmer and owner need to address jointly.

What are the kind of terms and conditions you can put into a lease?

The principal terms in a lease include:

  • Who the lease is between.
  • Details of the land and infrastructure involved.
  • The duration of the lease.
  • The price and payment mechanisms.
  • Secondary and often equally important terms vary from lease to lease but can include:

  • Who has responsibility for hedgerows and boundary fencing?
  • Water and ESB.
  • Insurance.
  • Farming practices.
  • Farm returned as good if not better than received.
  • Maintenance of infrastructure.
  • What is most important is that both parties are very clear as to what they are entering into and what is agreed.

    Do you have to lease all of the farm or can you lease in part?

    You can lease all or part of a farm. Many landowners looking to step back may lease part of the farm and retain a smaller part. This can work very well – they get the income and security benefit of a lease while still remaining an active farmer but to a lesser extent.
